I’m… not sure what I’d expect to happen here.
If the age-restriction was for, say, content potentially unsuitable for those ~ 13 years of age or lower, I think Kagi having a ToS saying you must be at least that age and bypassing the restriction would make sense. Realistically, I’m not sure there’s much to be gained from the legal minefield of attempting to catch to such young users in the first instance…
But YouTube / Google / Alphabet clarifies the line they draw in the sand is at 18 years of age. I don’t know if Kagi really wants to argue that teenagers shouldn’t be using their service, as that’s often the kind of age that tech enthusiasts first start developing an interest in technology & privacy. It, at best, seems like an oversight to allow such users to bypass such an age restriction. We have to assume that - at least some of the time - the restrictions are placed for good reasons.
I don’t know if Kagi wants to argue they’re pro-privacy and ask to see a photo of you holding your passport or some such, but then I don’t think YouTube itself seeks to verify your age - iirc, they just ask for it and at that point the onus is on the user in question? Kagi could have an optional date of birth field in account settings, and bypass the restriction for anyone who “is at least 18 years of age” as per the information provided by the user.
